Taylor Swift is known by the music industry as an artist advocate for getting Apple to pay royalties for Apple Music’s streaming trial period.

Even if what they’re paying is next to nothing.

And she practices what she preaches, as seen by the removal of her music from Spotify.

But back in November of 2014, Swifty celebrated her album 1989 breaking sales records… by technically breaking the law!

Swift was seen in a video posted to her Facebook, now with nearly 10 million views, lip syncing to Kendrick Lamar’s song Backseat Freestyle.

And while it looked like a whole lotto fun, legally, Taylor should have contacted the publishers of Backseat Freestyle to negotiate a sync license, AND contacted the label for a master use license.

BUT ALAS our girl did not follow protocol that she has in many ways fought for.

Now on Facebook’s end– they should have taken down the video. But the site often lets cover videos and fan created videos live on as it drives traffic to their platform, and has even been attributed to to helping the success of a song.

The laws are complicated surrounding music on the web. But I’d love to know your thoughts. Should Taylor Swift be in trouble? Should the video be taken down?
